Federal Court Issues Preliminary Injunction in Favor of EMED
EMED Technologies today announced that a U.S. federal court has issued a preliminary injunction in EMED's favor against Repro-Med Systems, Inc. (d/b/a RMS Medical Products), restricting RMS's ability to distribute and sell certain products designed for Subcutaneous Immunoglobulin (SCIg) infusion.
The injunction concerns two RMS product lines — safety needles and home infusion pumps — used for the subcutaneous administration of immunoglobulin therapy. The motion followed a determination by the U.S. Food and Drug Administration that the products in question were "misbranded" and "adulterated," and therefore potentially dangerous to patients.
The motion for a preliminary injunction was filed by John B. Thomas and Eric Grant of Hicks Thomas LLP, on behalf of EMED, in the United States District Court for the Eastern District of California.
