Patent Trial and Appeal Board Denied RMS its Attempt to Invalidate EMED's United States Patent No. 9,808,576
EMED Technologies today announced that the U.S. Patent Trial and Appeal Board (PTAB) has denied Repro-Med Systems, Inc. (RMS) its petition seeking to invalidate the claims of EMED's United States Patent No. 9,808,576 (the '576 patent).
RMS had attempted to use Inter Partes Review (IPR) proceedings to invalidate EMED's patents in order to avoid claims of infringement related to RMS's needle sets. After review, the Board found that the prior art cited by RMS did not invalidate the claims of the '576 patent.
EMED's safety needle patent family carries a priority date of 2008 and includes several issued patents covering critical aspects of safety wing designs used in subcutaneous infusion sets — tubing systems with a needle used to deliver drugs to the body.
The decision reaffirms the strength of EMED's intellectual property and the Company's continued leadership in the design of safety needle sets for subcutaneous infusion of immunoglobulin and other specialty drugs.
