EMED Alleges RMS Continues to Mislead the Public
In a litigation update issued from El Dorado Hills, California, EMED Technologies today alleged that Repro-Med Systems, Inc. (RMS) continues to mislead the public regarding the status of EMED's intellectual property and the parties' ongoing patent disputes.
EMED's '476 patent remains in force and is the subject of an open litigation case, while review of a decision invalidating other claims is being sought. Despite RMS's ongoing attempts to invalidate EMED's intellectual property, the U.S. Patent and Trademark Office has continued to issue patents related to safety needle design in EMED's favor.
EMED alleges that RMS's invalidation attempts are geared toward enabling the continued copying of EMED's innovative devices, rather than reflecting a genuine prior-art challenge to the underlying inventions.
